Fab Packers And Movers is Refusing to return the goods that were given to him to transport

For my house shifting I had availed the services of online shifting company Assureshift and they had recommended their franchisee Fab Packers And Movers. On the 18th of April 2022 my goods pick up was scheduled at 8:30 Am. The proprietor though had promised that he would come personally and over see the packing and loading, , he did not come. He had sent his truck and three labourers without a shred of packing material. They were just picking up my furniture, fridge, oven, cooker, table fan and other stuff as naked as they were and dumping them into the truck. They were putting all my kitchen utensils, my shoes, my clothes inside my bedsheet like the washer men. I objected as soon as they started taking my goods without any packing by way of whattsapp message to the proprietor but he was very rude to me. He said you don’t talk now but when your goods are delivered. When my goods were delivered they were totally destroyed because neither my goods were wrapped with packing materials nor they were secured in the truck. I hadn’t hired a pickup truck but a packers and movers company. My goods were all brand new, my furniture was just three months old and my fridge was just four months old, I had the bills of my furniture and fridge which I had provided to the transporter after the destruction of my goods so that he knows that he has destroyed my brand new goods

But the transporter was not bothered about the total loss of my furniture, he was only interested in collecting his transportation bill . Not only my goods were damaged, a lot of my things were stolen including cash from my bag. The transporter recovered my goods by giving a police complaint in ACES Layout police station against his driver, but refused to return the stuff that he recovered from his driver, he kept them for himself. When I complained to Assureshift they made him return my curtains, but enraged that he was made to return the curtains which he had refused to give upon my repeated request for almost two months, he trashed them with black paint and grease. Assureshift had asked the transporter to repair the fridge but he kept it in his godown for 45 days and said there is nothing that can be done to the fridge which was like some one has drunk coke and stomped on the can. When Assureshift gave him a dead line of three weeks he got the front two doors of the fridge changed though there was still a lot of damage. The damage to the fridge was extensive and it was out of function for over two months, so I asked the Fab guy to get it checked by Panasonic and issue a certificate that they have checked the fridge and it’s working considering my fridge was under warrenty and it was Panasonic that had replaced the fridge doors Fab guy said there is no such a thing called checking the fridge and certifying, he said fridge is not under warranty though he was very well aware that the fridge was only 4 months old because I had provided him with the bill. I told him after he trashing my 12 thousand rupees curtains I can’t take a chance with the fridge, Fab guy said he will never deliver the fridge, matter is closed. I have repeatedly through my WhatsApp messages asked him to return my fridge with or without certification. But he is issuing me threats that unlike me he is a local, , he has influence he will come after me, he knows what to do to me, when to do how to do. He has not returned my stolen things, he has not paid any damage to the destruction of goods. It is he who said I will never deliver the fridge, now he is telling me fridge is lying in his godown and he has the right to sell it. He said he would give me two days time to give him 25 thousand rupees, failing which he will sell my fridge and recover his money. I complained to BBMP, the
trade licence issuing authority don’t know whether they suspended his licence or not. Why Assureshift recommend thim when others also have said Fab guy has stolen their cargo.

It is my fridge, I have paid for the fridge, it was given to him to transport it safely which he failed to do, now he is refusing to return me my fridge, he is trying to extort 25 thousand rupees from me for my own fridge. He has neither returned my stolen things not has paid any compensation for the damage.
